This claim also asks for these communities to be exonerated of the military compensation fee (a sum of money that young men can pay in order to receive their military card without doing military service).</p> <p>The lawsuit states that indigenous communities but also black, afro-Colombians, <em>raizales, palenqueras</em> and <em>ROM</em> communities are ethnic groups that, according to the Constitution, are entitled to group-differentiate fundamental rights.</p> <p>The Ombudsman's Office presented a concept to the Court supporting the arguments of the lawsuit, ensuring that the current norm is against the principle of formal equality or prohibition of discrimination.</p> <p>On the contrary, the Ministry of Interior recommended to the Court not to change the actual norm arguing that “the equality right doesn’t exclude giving different treatment to individuals that are under the same circumstances if there’s a reasonable argument that justifies it”. conscientious objectors continue to be imprisoned, some governments are considering introducing compulsory military service for women covering it up with gender equality and anti-discrimination discourses. This has been the case in recent years for countries like <a href="https://wri-irg.org/en/story/2019/mexico-labour-party-propose-introduction-compulsory-military-service-women">México</a>, <a href="https://wri-irg.org/en/story/2020/colombia-vice-presidency-proposes-promoting-women-recruitment-stop-violence-against">Colombia</a> and the <a href="https://wri-irg.org/en/story/2020/us-congress-extend-draft-registration-women">United States</a> as WRI have documented previously.</p> <p>Now, in South Korea, some presidential candidates from both opposition parties stated that, in the case of being elected, they will introduce military service for women, arguing that gender equality will be achieved only when women have equal opportunities to participate in “domestic defence”. Although a proposal as such will need a debate and the overall approval of South Korean citizens, it is still concerning that this is on the agenda for some of the presidential candidates.</p> <p>In the same way, in Switzerland, the Federal Department of Defence currently is evaluating four options for compulsory military service, which could include conscription for women. The Swiss Officers’ Association – SOG (an umbrella organisation for regional military officers’ associations in Switzerland that is independent of the government) using this same anti-discrimination discourse claims that “both genders should have the same rights and duties in the military”. </p> <p>At the same time in the United States, Congress has been debating to expand the current draft registration to women. This, after the recommendations made by the National Commission on Military, National and Public Service in its report on March of 2020. Now, the president and the Democratic Congress could incorporate into the Fiscal Year 2022 Annual National Defence Authorization Act (NDAA) the order for women to register into the selective draft registration.</p> <p>In some cases, these kinds of proposals have been made under the argument that the voluntary registration or enlistment for women is not attractive for them and that the armies are not meeting the recruitment quota every year. This happens especially in countries where conscientious objection is recognised, and young men opt for the alternative service option if it’s available for them.</p> <p>Gender equality, anti-discrimination and equal opportunities claims are being misused by the governments to masks these law projects and proposals trying to make them unquestionable. Promoting compulsory military service as an opportunity for women to be part of civil life <a href="https://reason.com/2021/07/23/women-are-on-the-verge-of-being-forced-into-military-conscription-due-to-a-perverse-notion-of-equality/">is unlikely to traduce itself in more freedom or less discrimination for them</a>. field--item"><p> </p> <p>International Conscientious Objection Day (CO Day), 15th May, was celebrated with actions and events by activists from around the world in solidarity with those who have and those who continue to resist war. </p> <p><strong>This year we had a particular focus on Turkey. In Turkey,</strong> there are thousands of COs who refuse to perform compulsory military service. <strong>The right to conscientious objection to military service isn’t recognised and anyone refusing compulsory military service faces lifetime persecution.</strong> This includes continuous arrest warrants and repeated prosecutions amounting to <strong>“civil death” </strong>– a term being used to describe their exclusion from social, cultural and economic life.</p> <p>During the week of 15th May, together with <em>Quaker United Nations Office (QUNO) </em>and <em>International Fellowship for Reconciliation (IFOR</em>), <strong>we held our fourth webinar</strong> as part of our webinar series "Campaigning for Conscientious Objection to Military Service". <strong>In the webinar <em>International Solidarity: Turkey Case </em>we heard directly from COs themselves as well as the activists who campaign for the recognition of the right to conscientious objection in Turkey.</strong> You can watch the recordings of all the webinars here on our Youtube channel <a href="https://www.youtube.com/channel/UC0WZGT6i5HO14oLAug2n0Nw" rel="noopener" target="_blank"><em>Refuse to Kill</em></a>. </p> <p>Also, <em>War Resisters International</em> office together with <em>Conscientious Objection Association (Turkey) </em>and<em> Connection e.V.,<strong> </strong></em><strong>released and collected a number of resources</strong> - including publications and video interviews -<strong> to continue amplifying the voices from COs in Turkey </strong>and raising awareness on the situation of conscientious objection in the country. You can all check the available resources<a href="https://wri-irg.org/en/CODay2021"> here</a>. </p> <p><strong>We organised an email action</strong> where we encouraged people to send an email to the Turkish embassy in their countries <strong>urging the Turkish Government to recognise the right to conscientious objection</strong>. Affiliates from around the world joined us in this email/letter action delivering letters to the Turkish embassies in their countries. Finally,<strong> we made a call out </strong>inviting people, groups and organisations to <strong>post on their social media sharing information about conscientious objection in Turkey and how COs continue to be persecuted</strong> for refusing to be part of the military. <em>La tulpa Collective</em> from Colombia and<em> Movimento Nonviolento</em> from Italy joined this social media action. We also wanted to show solidarity with those who are suffering imprisonment and stigma today for refusing to carry out military service in countries where there is still no right to register as a Conscientious Objector."</p> </blockquote> <p><strong>In Greece, </strong><em>Amnesty International Greece</em> released a video with conscientious objectors from Turkey and Greece, you can watch it <a href="https://www.facebook.com/88027997208/videos/930580241097753">here</a> (in Greek). They also organised an action in front of the Greek Parliament and the Turkish Embassy in Athens. </p> <p><strong><em>European Bureau for Conscientious Objection (EBCO)</em> </strong>published a press release highlighting the courageous struggle of conscientious objectors and activists in Turkey. In <a href="https://www.ebco-beoc.org/node/503">this press release</a> EBCO's president Alexia Tsouni stated:</p> <blockquote><p>“Turkey is the only member state in the Council of Europe that has not recognised the right to conscientious objection to military service, or at least indicated the intention of making civilian service available, and keeps prosecuting conscientious objectors and activists. Giraldo</strong></p> <h3>Issues</h3> <ul> <li> <p>Illegal recruitment is still taking place in most major cities in Colombia. In many cases, this process is ignored by the authorities;</p> </li> <li> <p>No law regulates the right to conscientious objection, though the right has been recognised by the Constitutional Court;</p> </li> <li> <p>Forced recruitment is undertaken by non-state armed groups.</p> </li> </ul> <h3>1 Conscription</h3> <p><em>conscription exists</em></p> <p>All men between the ages of 16 and 28 are liable for military service. Every man has to define his military situation before the age of 18<a href="#sdfootnote1sym" id="sdfootnote1anc">1</a>, even if he has a right to exemption or postponement. Schools are obliged to draw up a list of students in their last year of high school and submit it to the military. Even if they have not yet finished their studies, in some districts they are already eligible for conscription. Once enrolled in the conscription process, they are subject to psychological and physical tests, and then the authorities undertake a raffle to randomly select regular soldiers (to serve from between 18 to 24 months), 'bachelor' soldiers (to serve for 12 months), police officers (to serve for 12 months) or rural soldiers (to serve from 12 to 18 months), depending on the local authorities and the military district. Each local military district determinates what type of soldier they need, and the length of service.</p> <p><em>postponement and exemption</em></p> <p>The law that regulates military service is no. 48 of 1993. It determines that military service, even though is mandatory for every adult man, has some exceptions. These are (i) regular exemptions – without payment of military compensation - and (ii) peace time exemptions – with payment of military compensation.</p> <p>Regular exemptions:are available to (i) people who have physical and sensory limitations and (ii) indigenous people who live in their territory and preserve their cultural, social and economic integrity.<a href="#sdfootnote2sym" id="sdfootnote2anc">2</a></p> <p>For the former group, citizens who have cognitive or mental deficiencies do not have any difficulties in gaining their exemptions. However, for indigenous people, the process is not so easy. Recently, the <em>Defensoria del pueblo</em> published a list of acts that consistently violate the rights of indigenous people. These included the process for exemption, by which the military judges the veracity of claims to indigenous status. They use either an outdated census, or a certificate issued to an individual by their community, which the authorities do not always recognise.<a href="#sdfootnote3sym" id="sdfootnote3anc">3</a></p> <p>In peace time, exemptions are available to (a) clergymen and full-time religious people, (b) convicts who have lost political rights, (c) children without siblings (d) orphans who are supporting siblings, (e) children of disabled fathers aged 60 years or over, (f) brothers or children of injured during military service, (g) married men, (h) partially disabled people and (i) children of <em>Fuerza Pública</em> (Public Force) officers who died or acquired a severe disability in combat or during military service.<a href="#sdfootnote4sym" id="sdfootnote4anc">4</a></p> <p>Additionally, law 1448 (of 2011) adds a further peace time exemption (without the payment of military compensation) to all the victims of the armed conflict who have defined their condition through the registry system of victims - RUV.<a href="#sdfootnote5sym" id="sdfootnote5anc">5</a></p> <p>Law no. 48 of 1993 outlines the following situations where postponement is possible: (a) having a sibling who is currently undertaking military service, (b) being detained by civil authorities in the period of recruitment, (c) being temporarily disabled, (d) having been accepted, or already be studying, in establishments recognised by the ecclesiastical authorities, like preparation centres of religious life or a clerical career, (e) be enrolled in a training school for officers (f) being enrolled on the last course of high school, the loss of which would prevent them from finishing the course (g) conscript men who claiming an exemption in explicit accordance of the present law.</p> <p>Law no. 548 of 1999 adds young men who are doing advance higher education. In 2001, it was clarified that those who are enrolled in an undergraduate programme can postpone the definition of their military situation until their studies are completed.<a href="#sdfootnote6sym" id="sdfootnote6anc">6</a> Unfortunately, in the military districts there is not a clear idea of what advance higher education means: some think it includes technical education, but other districts it only includes university education. Additionally, those who do not define their situation at the end of their studies cannot obtain their professional title.</p> <p><em>forced recruitment</em></p> <p>Arbitrarily, men are taken to military barracks with the aim to force them to register, take exams and, if suitable, incorporate them immediately into the army. Even though the Constitutional Court has prohibited such detentions, known as <em>batidas</em>, they are still being performed, usually with unidentified means of transport, such as trucks without plates or school buses.<a href="#sdfootnote7sym" id="sdfootnote7anc">7</a> In general, these practices are taking place in Bogotá by military districts from other regions, therefore, the illegally recruited men are transferred to other towns where the authorities verify their military situation and, if suitable, they are incorporated immediately.<a href="#sdfootnote8sym" id="sdfootnote8anc">8</a></p> <h3>2 Conscientious objection</h3> <p>The Constitutional Court's ruling c-728 of 2009 recognises that conscientious objection is a reasonable grounds for military service exemption, however, it also states that there is no need for a specific regulation to outline this right. In other words, such a law still does not exist. After a few political efforts to regulate conscientious objection<a href="#sdfootnote9sym" id="sdfootnote9anc">9</a>, the debates did not gain much public attention and have always been shelved. Certainly, applicable legal sub-rules exist<a href="#sdfootnote10sym" id="sdfootnote10anc">10</a>, however the ignorance of the authorities, the difficulties in assessing the evidence and the judicial silence means in reality this right is not available.</p> <p>According to the National Recruitment Agency's figures, 80% of cases of conscientious objectors invoke religious reasons and 20% cite ethical and philosophical motivations. Until 2005, there were five successful cases. The first recognition of a conscientious objector was resolved in 2009, however this not widely known amongst conscripts. According to Diego Carreño, a member of <em>Accion colectiva de objetores y objetoras de conscienca</em><em> </em>(ACOOC), four out of the five cases citred religious motivations, and one political.</p> <h3>3 Draft evasion and desertion</h3> <p>Those exempted from the provision of compulsory military service by: (a) any of the reasons provided by the Article 28; (b) a disability; or (c) if a district has already filled its quota of soldiers will be regarded as "classified" and will have to pay a contribution to the National Treasury, called a "military compensation fee". The minimum amount for a military compensation quota will not be less than 50% or 60% of the legal monthly minimum wage. The total family income and assets of the person concerned, or of the person on whom he or she demonstrates financial dependency, will be used as the basis for this calculation.</p> <p>Currently, young people who avoid recruitment or are not enrolled must pay a fine equivalent to 50% or 60% of a the monthly legal minimum wage. Those who evade the draft, but then later do perform military service, are exempted from paying a fine and a compensation fee. Colombians who do not define their situation not only incur a fine, but cannot access a number of goods and services, as well as rights to education and work. Therefore, the worst and most coercive sanction for perceived draft evasion or desertion is the apparent death of political and civil citizenship.</p> <p>There is no procedure to ensure that citizens are immediately discharged when applications for exemption or deferral are favourably resolved. It takes between 20 and 40 days, even when the exemption or deferral tests are completed, and often the military authorities refuse to carry out the procedure for purely bureaucratic reasons. There have been cases in which irregular disruption of recruitment takes up to 4 months to be resolved.<a href="#sdfootnote11sym" id="sdfootnote11anc">11</a></p> <p><em>forced recruitment by non-state armed groups</em></p> <p>There is also forced recruitment into non-state armed groups, including children. Sentence C-781 of 2012 of the Constitutional Court demands that every under-age child - male or female - recruited or used by <em>guerrilla</em> and paramilitary groups for war purposes or intelligence be recognised as a victim of war. class="Standard" style="text-align:justify"> </p> </div> <div> <p>For many years, Colombia has been a country where inequality and systematic violence have claimed the lives of innocent people. The armed conflict and the actions of the State have made the violation of human rights something that takes place daily, and we are even used to living in such conditions. In 2020, the coronavirus outbreak started and with it, Colombia and the world got involved not only in a health crisis, but also in an economic and humanitarian crisis. Thus, the structural violence that has permeated the daily lives of many Colombians began to reach the reality of people who may have been unaware of it or simply preferred to ignore it. It became clear that the State only listens during election campaigns and it only cares about people and their rights when they need a vote. Since 2019, people showed its discontent, tired of not being able to access neither education nor a decent job, but especially, tired of being massacred daily, becoming another statistic in the eyes of an indolent government. The pandemic was like firewood that lit the fire of tiredness and the desire to be a better country, or at least, to live in a country where lives matter.</p> <p>One of the challenges the Colombian social movement has to face is to make the international society understand that the armed conflict is a deep historical tragedy, but it is not the cause of the structural problems the country is experiencing; it's one of the consequences of an economic and political model based on the extermination of the most impoverished. The social conditions uncovered by the pandemic in Latin America, are perceived today in Colombia as a time bomb fed by a record of 500 deaths per day by Covid-19, a late and precarious vaccination process by corruption mafias with only 4 million people who have received the dose (10% of the population), while the government shows total disinterest to reduce unemployment and systematically refuses to implement a basic income for the most affected populations. Colombia is in the list of the 10 countries with the highest inequality in the world.<a href="#_ftn1" name="_ftnref1" title="" id="_ftnref1">[1]</a>.</p> <p>Ignoring this situation and the people demands, the government has made its priorities clear by allocating close to COP$9.5 billion pesos to buy 81,000 tear gas grenades and 13,000 bullets used by the ESMAD police, in addition to 23 vans for presidential protection for COP $9.600.000.000 ($2,546,486.43 dollars), 18 police tanks for $12,000.000.000 pesos ($3,183,108 million dollars) and 3 vans for security schemes for Army commanders, estimated at COP$812.000.000 ($218,649dollars)<a href="#_ftn2" name="_ftnref2" title="" id="_ftnref2">[2]</a>. One of the first achievement of the social monifestations in 2021 was the resignation of the Minister of Finance and the government's announcement retracting its decision to spend 14 trillion colombian pesos on 14 warplanes ($3,714,597,190 million dollars). It's estimated that this money could be used to buy 300,000 vaccines saving approximately 150,000 people's lives<a href="#_ftn3" name="_ftnref3" title="" id="_ftnref3">[3]</a></p> <p>Indignation about the humanitarian crisis that the country is going through has been reflected in the streets, a crisis which was aggravated by the tax reform proposed by the president Duque, which he called a "sustainable solidarity law". In this reform the government proposed to raise close to 23 trillion Colombian pesos (about $6.3 billion dollar) to supposedly meet the needs of the pandemic; the problem is that at least 73% of this revenue would come directly out of the pockets of the middle and lower classes of Colombian society.<a href="#_ftn4" name="_ftnref4" title="" id="_ftnref4">[4]</a>.</p> <p>This reform proposed charging an income tax for people with a salary of more than US$663, in a country where the minimum wage is US$234. In addition, it was proposed to apply the Value Added Tax (VAT) on food of the "basic food basket", public services (water, electricity, gas), electronic objects such as computers and cell phones, farm tools such as fishing nets or irrigation systems, funeral services, internet service, as well as the increase of this tax on tools used to collect solar energy.</p> <p>Thanks to the massive manifestations and protests, the government was forced to withdraw the tax reform bill and change its discourse, however, its intentions have been exposed, especially considering the systematic militarisation and repression of the protests.</p> <p>According to information provided by the NGO Temblores, after 8 days of protests, 37 murders have been reported by the police, a horrible number if we take into account that in Chile, during 150 days of manifestations in 2019 about 34 people died, and in the United States there were about 30 civilian deaths after the assassination of George Floyd in 60 days of manifestations.<a href="#_ftn5" name="_ftnref5" title="" id="_ftnref5">[5]</a>.</p> <p>Although these figures are regularly updated everyday, Temblores has documented the actions of the police reporting 222 victims of physical violence, 831 arbitrary detentions, 312 violent interventions that disregarded protocols, 22 victims of aggression in the eyes, 10 victims of sexual violence and at least 110 situations where firearms were fired against demonstrators<a href="#_ftn6" name="_ftnref6" title="" id="_ftnref6">[6]</a>. Despite the deep militarization, the media siege, the restrictions to internet access, the impunity promoted by the mass media and the stigmatization of those who remain in the streets, the protests continue, people demand the resignation of the president Iván Duque, who is popularly known as the sub-president under the fearsome Álvaro Uribe Vélez.</p> <p>These days of manifestations reaffirm that the problem is not the tax reform, but the eroded consolidation of a political and economic project that intends to perpetuate the war at all costs: it has defunded the peace process with FARC and has closed all possibilities of dialogue with ELN guerrilla, it has also renewed its military doctrine to control, no longer over due to theinternal conflict, but to control and repress the civilian population. This project rejected by colombian people favors the privatization of fundamental rights and promotes the spraying of glyphosate<a href="#_ftn7" name="_ftnref7" title="" id="_ftnref7">[7]</a>, as well as the exploitation of raw materials under the discourse of progress and sustainability.</p> <p>Among the many needs of the Colombian people, today we highlight the importance and urgency of effectively dismantling the Anti-Riot Squad (ESMAD), which after 20 years of its supposedly "temporary creation", has killed 34 demonstrators in the countryside and cities of Colombia. This dismantling is urgent in order to redirect the democratic order kidnapped by a paramilitary mafia in power.</p> <p>That is why today we are making an urgent call for solidarity. A call that is being replicated by many people and organizations in different places, challenging the discourses of war and fear that today find an absolutely opposite correlate to the cultural resistance, the bets for change and the possibility of building horizons more in line with the reality of the Colombian people and their proposals to materialize peace from the territories, in The demonstrations began on 28<sup>th</sup> April 2021 as a general strike was called in response to an unpopular tax reform and the mishandling of the Covid-19 pandemic. The protesters were met by the ESMAD riot police, who used teargas, bean-bag rounds and batons. Dozens have been killed and three officers have been <a href="https://www.theguardian.com/world/2021/may/12/colombia-protests-reaction-responses-cali-bogota">charged with murder</a>.</span></p> <p><span style="line-height:100%">The response to the protests have been led by the<i> </i><span style="font-style:normal">Escuadrón Móvil Antidisturbios (ESMAD) – Mobile Anti-Disturbance Squadron – who have repeatedly used highly militarised tactics and equipment to suppress dissent. They use a range of weapons produced by companies from Colombia and other countries around the world. For example, between 2015 and 2020, Spain exported over </span></span><font style="vertical-align:inherit"><font style="vertical-align:inherit"><font class="goog-text-highlight"><a href="https://www.eldiario.es/amnistiaespana/venta-armas-colombia-e-israel-curar-no-haber-prevenido_132_7934446.html">€70 million of weapons to Colombia's police and military</a>.</font></font></font></p> <p><span style="line-height:100%"><span style="font-style:normal">The Colombian activist collective <a href="http://sinmiedo.com.co/defensa.html">Sin Miedo has identified a wide variety of weapons</a> and companies believed to be supplying ESMAD. Weapons produced by Combined Systems, Inc have been identified as used against protesters in countries around the world.</span></p> <h1 class="western">Defense Technology</h1> <p>In a Twitter post from 2019, the director general of the National Police of Colombia shared several photos displaying less-lethal weapons used by ESMAD. These clearly show a number of weapons sold by the US company Defense Technology. A twitter post from a human rights group in Medellin included a number of photos of members of ESMAD. One showed a "Poseidon" water cannon produced by a Colombian company called Kobe, based in Bogota. Kobe produces vehicles for the police and emergency services. the concepts of nonviolence and conscientious objection, supports alternatives to Colombian militarism, militarization, and the patriarchy, via legal, public campaigning, and educational strategies. Since 2006, ACOOC has worked alongside young people and their communities with to cultivate a peaceful culture.</p> <p>ACOOC is made up of an interdisciplinary team that combines legal, educational, psychosocial, communicational and investigational knowledge and experiences, which, in turn, are the components that make up the organization:</p> <ul> <li><strong>Legal, political, and psychosocial support</strong>: here we focus on consulting and accompanying young conscientious objectors and those at risk of being recruited, providing legal and psychosocial backing that supports their basic rights.</li> <li>From a <strong>training </strong>perspective, the organization offers educational tools which provide young people with a greater understanding of how to exercise their basic rights regarding illegal recruitment, compulsory military service, and preventing violence. It is a commitment to improving the subject’s understanding of legal and conceptual matters regarding his or her rights, and therefore building alternatives to militarization.</li> <li>The purpose of <strong>nonviolent direct action and public campaigning</strong> is to develop communication strategies and promote our experiences and goals. Nonviolent direct action is the main focus, and is promoted via public lectures- in-person and online- which provide opportunities for reflection, awareness, and collective creation. Secondly, we provide spaces for critical thinking about the relationship between militarism and the patriarchy, and- from a male-centered, nonviolent perspective- the corresponding effect these two things have on gender-based violence. One of the most-recent initiatives addressing these problems is the group named <strong>Invisible Violence</strong> (Violencias Invisibles), which, via personal testimonies, is dedicated to researching gender-based violence carried out by armed force members on their partners, and whose research demonstrates the connection between said violent acts and archetypical, patriarchal social norms: <a href="http://especiales.datasketch.co/violencias-invisibles/">http://especiales.datasketch.co/violencias-invisibles/</a></li> <li>Our <strong>social and political advocacy</strong> component develops strategies for strategic relationships with other organizations and institutional influences, which help us to build networks to solidify the collective efforts that would result in favorable conditions in protecting the fundamental rights of young people.</li> </ul> <p>The relationship between ACOOC and the WRI (War Resisters International) began in 2006 following Colombia’s first international conference for solidarity for conscientious objectors. It was at this conference that a network of support was formed for young people - in the form of in-person accompaniment during court procedings - in which the WRI has combined efforts with other international allies that account for the visibilization of Colombia’s conscientious objectors movement and the related militarization concerns in Colombia.</p> <p>In 2019, ACOOC was among the groups that headed up the organization of the Conferencia Internacional Antimilitarismos en Movimiento, and is one of the initiatives that struggles for demilitarization and the elimination of military service in Colombia.</p> <p>Some of the key initiatives that ACOOC dedicates itself to are its training programs with youth organizations and institutions that promote the right to conscientious In the face of this, community struggle over access to land and the guarantee of human rights is legitimate. These forms of resistance foresee positive ways forward in the face of a government that perpetuates a vision of territory from a mercantilist perspective and that - in one way or another – uses a warlike logic.</p> <p>Since 2011, there have been efforts to combat forced eradication and glyphosate aerial spraying of illicit crops (coca leaf), as well as enabling the return of victims of forced displacement to their land. One of the alternatives to forced eradication are crop substitution projects, through productive projects that improve the structural conditions of poverty in these communities. However, the position of the current government, alongside pressure from the United States, has meant the development of such strategies has dropped significantly. In addition, the return of forced eradication has been prioritized, which is once again consolidated as a repressive measure without guarantees and which leaves a high cost in terms of human rights.</p> <p>Furthermore, irregularities in this process are constant, given that the absence of institutions, which by law must verify and confirm the actions of the Armed Forces in the territories, is extensive and is being justified by the current pandemic<a href="#_ftn1" name="_ftnref1" title="" id="_ftnref1">[1]</a> .</p> <p>Considering all this, communities, being threatened constantly, are demanding the guarantee of their rights. One example is the agricultural workers of southern Córdoba (Social Agricultural Workers Organization, defenders of human rights and the peace agreements) who have mobilized against forced eradication "in order not to allow further progress in what appears to be a government policy that does not recognize and does not effectively implement the peace agreements with the FARC-EP, as signed in November 2016<a href="#_ftn2" name="_ftnref2" title="" id="_ftnref2">[2]</a>.</p> <p>The publication of the Observatory for the Restitution and Regulation of Agrarian Property Rights<a href="#_ftn3" name="_ftnref3" title="" id="_ftnref3">[3]</a> shows that in 2020 there were 51 confrontations between agricultural workers and the Armed Forces; in 20% of these firearms were used by the Army. In Guaviare and Meta, where communities have mobilized to demand their rights, those actions have been criminalized, stigmatized, and the state response has disproportionately used military operations that have threatened people's lives. In Cúcuta, ASCAMCAT (Asociación Campesina del Catatumbo, Catatumbo Growers Association) and COCCAM (Coordinadora de Cultivadores de Coca, Marihuana y Amapola, Coordination of Coca, Marijuana and Poppy Growers) have denounced the launch of forced eradication works and demanded the monitoring of human rights violations. Thus, the government militarization strategies to control territories has led to the violation of human rights, ignoring the peace agreements and attempting silence resistance.</p> <p>Under this same logic, glyphosate aerial spraying, suspended since 2015, is returning as a crop eradication strategy, which accentuates the government's clear inability to create alternative productive strategies for illicit crop reduction. It is important to understand that returning to this practice is a decision that goes against scientific evidence which has focused on demonstrating the impacts glyphosate has on health and the little effectiveness it has shown to reduce illicit crops<a href="#_ftn4" name="_ftnref4" title="" id="_ftnref4">[4]</a>. Thus, the government's approach regarding the use of glyphosate is to determine whether the life and health of the communities that inhabit these territories are of state interest and, consequently, whether it corresponds to the constitutional mandate to safeguard people's lives.</p> <p>Glyphosate resistance struggles have always been constituted by hundreds of agricultural workers. On the national scene, it is important to recognise leaders such as Nidia Quintero, spokesperson for COCCAM and member of Fensuagro, who, along with other agricultural workers leaders, succeeded in making Putumayo the first department to sign agreements around collective illicit crop substitution projects. However, with the arrival of Iván Duque’s government, the program was halted, and the violence and presence of armed groups began to increase. Arnobis Zapata, a leader recognized for his resistance strategies to the eradication plans, managed to stop an eradication commission for the first time in 2015. His work and struggle led him to the launch of COCCAM along with some 800 agricultural workers, Afro-Colombians and indigenous people who sought to pressure Santos government to implement point 4 of the peace agreements <a href="#_ftn5" name="_ftnref5" title="" id="_ftnref5">[5]</a>.</p> <p>After facing the refusal to implement the peace agreements and the intention to reactivate eradication of illicit crops, Juan Pablo Salazar, together with other leaders formed Asocordillera (Suarez Rural Farmers’ Organization Cauca) in 2016. Since that moment, resistance strategies have been maintained, seeking to reactivate substitution of illicit crops and to stop the entry of dissidents from FARC and drug trafficking groups to the territories. This year Ascocordillera managed to get Cauca’s Administrative Tribunal to back their battle focused on the implementation of the peace agreement, achieving the suspension of illicit crop eradication and glyphosate aerial spraying in the municipalities of Caloto, Cajibio and Piamonte in Cauca.</p> <p>The struggles of agricultural workers and indigenous communities have made progress from a legal point of view and are the ones that - amidst state abandonment and militarization of their territories - continue to demand crop substitution, alternative production strategies and guarantees of their rights.</p> <h2>Resistance across Colombia</h2> <p><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Arial,sans-serif"><span lang="EN-GB" style="font-size:12.0pt" xml:lang="EN-GB"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif">C</span></span></span></span></span></span>auca department has been one of the places in Colombia most affected by the violence of the armed conflict, the fight against drugs and the constant arrival of extractive projects that generate an environmental impact in indigenous territories. It is important to emphasize the fight against the eradication of illicit crops, as well as glyphosate fumigation, has begun to move to departments such as Cauca, Valle del Cauca, and Catatumbo<a href="#_ftn6" name="_ftnref6" title="" id="_ftnref6">[6]</a>. Likewise, the permanent persecution and murder of social leaders generates a panorama which accentuates the problem and directly affects communities of agricultural workers, indigenous and Afro-Colombians, as well as defenders of land and natural resources<a href="#_ftn7" name="_ftnref7" title="" id="_ftnref7">[7]</a>.</p> <p>However, since the late 1990s, the indigenous communities of Cauca have organized themselves in defence their territories, rejecting the systematic violence and militarization of their lands. The Armed Forces, through the war on drugs, constantly destroys their territories. The Indigenous Guard was formed in 2001, and has become a resistance that has begun to amplify indigenous voices and actions in their territories, through actions recognized nationally and internationally. Additionally, in recent months, the Indigenous Guard decided to mobilize from their territories and travel to Bogotá, raising their voices, asking to be protected and to be left to live in peace in their territories. They demanded the demilitarisation of their lands, but above all, that the government listen and stop ignoring them because they are being murdered in their territories. The Indigenous Guard is an example of community organization and territory defence without the need of the Armed Forces it is based on love for our indigenous roots, and respect for our lands, for nature and for life.</p> <p>On the other hand, since the times of the Colony and Benkos Biohó in the late 16th and 17th centuries<a href="#_ftn8" name="_ftnref8" title="" id="_ftnref8">[8]</a>, in the territories of Northern Cauca and San Basilio de Palenque, the Maroon Guard has been organized and strengthened. This resistance has provided a space for the Afro-Colombian people to demand their rights, exercise their autonomy, protect their territories, their ancestry and identity, as well as protecting themselves. The territories where this resistance is exercised currently face vital challenges, such as structural racism, environmental damage to their territories, violence by armed actors, and the pandemic. The pandemic has served to accentuate other problems, as well as  making visible the government's abandonment of one of the ethnic communities that are part of our country, in accordance with Colombia’s historical racism.</p> <p>It is also important to recognize that, in San Basilio de Palenque, the Maroon Guard plays a fundamental role in guaranteeing security. According to reflections made by the Observatory of Ethnic and Agricultural Workers Territories,  these places maintain the position of not receiving permanent support from the State This means that the Maroon Guard  has more responsibility for monitoring and controlling protected areas, and preventing, investigating and combating crime in the territory<a href="#_ftn9" name="_ftnref9" title="" id="_ftnref9">[9]</a>. For this reason, It is important to understand and reflect on the experiences of the Maroon Guard in finding alternatives to militarisation.</p> <p>At the same time, the territories where the Maroon Guard operates are already facing the consequences of climate change, putting these territories on the verge of collapse. This is caused by rivers drying up, as well as the scarce of rain season directly affecting crops. This situation not only damages the population but also, according to the Black Communities Process, is "an opportunity for those who have always sought to appropriate their agricultural reserves”<a href="#_ftn10" name="_ftnref10" title="" id="_ftnref10">[10]</a>. Finally, the state's abandonment has increased environmental, health and food emergencies that were already occurring in these communities. Nevertheless, we should recognise the resistance of these groups who, facing government abandonment, are organising themselves, demanding their rights and finding alternatives to a government that has discriminated and forgotten them throughout Colombia’s history.</p> <p>Resistance is a daily act and is our duty to face the growing climate change effects and resist governments who reinforce territory exploitation. These experiences should inspire us to continue to resist and fight for a better world for all the living beings that are part of it, as well as to return to the connection with our ancestral roots where respect and love for nature are a vital part of living. field--item"><p>Up to now, Colombia’s response to the pandemic - the Common Enemy - has been one of a familiar nationalist and militarist rhetoric, a staunchly-upheld, militarized response that is unfolding in Colombia’s towns and cities.</p> <p>We want to begin this report by addressing the serious militarization taking place within the context of the pandemic, and to assert that the fight will not waver, that our resistance will only become stronger. We feel it is necessary to emphasize that our resistance will not be put on hold during confinement, that indigenous people will continue to hold out against extractivist advancements; we will put a stop to legislative actions that favour extractavist aims, which offer no assurance that the respective communities are to be notified beforehand (External agencies in Colombia have a legal obligation to attain prior consent from communities in whose lands they plan to carry out activities). The solidarity of indigenous people has grown in several forms, borne of necessity and creativity: in Bogotá, we have bore witness to the indigenous Emeberá peoples’ methods of creating networks of solidarity, whilst living in uncertain urban environments.</p> <p>During lockdown, a commemorative Day of Conscientious Objection was organised, and an Antimilitarist Festival was celebrated on May 15th and 16th, with several different national organizations participating. This Festival marked a meaningful union among these organizations, celebrating all resistance movements struggle against militarization, and celebrating life, even as reports of deaths continued to emerge. It was a day for men and women to join together in an affirmation of our efforts to end militarism in Colombia.</p> <h1>Militarization during the pandemic</h1> <p>The State of Exception, which was decreed by the Government of Colombia on the 25th March 2020, has implemented measures mainly seen during States of Emergency. The State of Exception has given Colombia’s armed forces free rein to resolve issues by way of preemptive strike against the Public Enemy: Covid-19, a biological microorganism, invisible but deadly, which, as the weapons division of the Colombian Government would understand it, is to be defeated by force.</p> <p>In the beginning, relief measures were limited to those of a health and safety curfew, but this quickly evolved into a military curfew. In April, the National Government issued a decree which, in addressing the pandemic, implies that governments and local entities collaborate with the central government and its armed forces. In this same vein, the Ministry of Defense has ordered the first-degree deployment of all its forces. Even those who choose to turn a blind eye to the effects that this epidemic has had on those who are already impacted by inequality will have noticed the red cloths that have sprung up around residents’ homes, a sad shorthand used to signal that its inhabitants are suffering from hunger and lack the basic food to survive.</p> <p>On May 18th, Colombia’s number of positive cases rose to 16,295, along with 592 deaths, a figure estimated as the start of the high peak of contagion in the country. It is important to clarify that the official figures are considerably smaller than the actual number of cases, given that the rise in positive cases is directly proportional to the number of tests performed, which have been “scarce”: 47,000 is an alarmingly small number of tests for a population of 49 million people. As the number of Covid-19 infections has increased, impoverished communities have faced constant xenophobic attacks as their protests, in which displaced families living in makeshift shelters decry the lack of basic rights and necessities, are put under siege.</p> <p>Colombia is at a boiling point; at least 19 human rights defenders and social leaders have been assassinated in Colombia as of this year, and there are 34 other deaths currently being investigated due to their possible connection to activist causes. As the violence has gone unchecked during this health crisis, Colombia’s National Liberation Army (a left-wing guerrilla group which didn’t participate in Colombia’s peace negotiations) has declared a unilateral ceasefire and has proposed that the government reengages in talks through the La Habana delegation.</p> <h1>Protest suppression in the cities</h1> <p>Protests demanding peoples’ rights have taken place in several areas throughout the country. Impoverished, working-class communities, donning red cloths, have seen their peaceful protests suppressed - protests that are a necessary call to action for a bare minimum of human rights. In Bogotá some were surprised by the local police’s attempts to raise neighborhood morale via dance classes and positive messages, broadcasted by loudspeakers - under the slogan “We are united as one”. What was not surprising was when, at the same time, the police began to evict residents from the “two-bit” homes where the poorest families reside.</p> <h1>Militarization and closed borders</h1> <p>As part of the quarantine orders, military action has been mandated by several legislators in the main cities. Several departments have made the decision to close the borders and passes that lead into other areas within the countryside, solidifying this position with a military presence. In the administrative district of Boyacá the government was called to militarize their territories and departmental borders. Other neighboring municipalities of Bogotá have followed suit (as well as in several stop-over areas), in a joint agreement to close off and militarize their communities.</p> <p>In mid-May, the government announced that it would be closing the border between the Amazon and Brazil. The city of Leticia was then occupied by military forces, whose soldiers have received medical attention that health professionals from the main cities’ hospitals still do not have. When they began this operation, the government announced that they “had made the decision to increase military presence at all border points and to exercise such control so as to prevent new cases from entering via the floating population.”</p> <p>The northern Pacific border in the department of Chocó, which is ancestrally inhabited by indigenous communities who are at risk of extermination due to multidimensional poverty levels and malaria outbreaks that remain present in the area, have been gravely affected during this pandemic. An increase in military presence in their ancestral lands has decreased tourist revenue and affected commercial trade with migrants traveling from Central America and the Caribbean.</p> <h1>Migrants during confinement</h1> <p>Migrants have often been painted as dangerous and frequently face evictions from their places of living due to lack of work. Many of these migrants, “even those without food, babies still in their arms”, according to the DW (Deutsche Welle), have had little choice but to return to Venezuela on foot. Despite the border closures, representatives from the Colombian government have been arranging the departure of migrants via humanitarian corridors, in which soldiers, who guard the countryside along the border, are allowing the reentry of Venezuelans into their country.</p> <p>Likewise in Bogotá, in the Santa Fe neighborhood which the trans community and a great many Venezuelan migrants call home, the streets have been militarized as a response to its inhabitants’ disobeyance of quarantine doctrines. In the city of Cali the police and the ESMAD (the Mobile Anti-Disturbances Squadron) have mounted a violent attack against a homeless community situated in a working-class neighborhood.</p> <p>The case been the same in Altos de la Estancia, a settlement of 350 families in a poverty-stricken sector in Bogotá, many of whom are migrants or belong to families displaced by violence, where an ongoing eviction raid has been carried out since mid-May.</p> <h1>Decree for the extension of conscripted service</h1> <p>As a result of the pandemic, this April 13th the government issued its Decree 541 2020, which will extend the duration of military conscription for men who would otherwise have been close to completing their service. No clear connection has been provided between this initiative, which impacts the constitutional rights of 16,241 young men, with the health crisis at hand.</p> <p> </p> <p> </p> <p> </p> </div> <!--
