It is long and complicated: on some of the questions before it the court was apparently split equally. We are still awaiting a full analysis from our Korean partners. But it does seem that the Court has ruled that the absence of any civilian alternative service option for conscientious objectors is in conflict with the freedom of conscience clause in the Constitution of the Republic of Korea, and have ordered the legislature to rectify this.</p> <p>This is a promising step, but it is not the end of the road. Much will depend on the details of the legislation eventually brought forward. Will it be in full conformity with international standards as elaborated by this Council<sup><a href="#sdfootnote6sym" name="sdfootnote6anc" id="sdfootnote6anc">6</a></sup> and applied to the Republic of Korea in the Concluding Observations of the Human Rights Committee?<sup><a href="#sdfootnote7sym" name="sdfootnote7anc" id="sdfootnote7anc">7</a></sup> In particular, will the alternative service be non-punitive in duration and other conditions? And will it be open to all objectors, irrespective of the particular beliefs on which the objections are based?</p> <p>There remain also to be clarified the implications for the hundreds currently in prison, the hundreds currently facing trial and the tens of thousands of past objectors continuing to live with the stigma of a criminal record.</p> <p>Nevertheless, we rejoice that at long last there issues of military service and freedom of conscience in Kyrgyzstan. The specific concerns it raises are:</strong></span></p> <p><span><strong>The recognition as conscientious objectors to military service only members of specific religious denominations, and discriminatory features of the alternative service available.</strong></span></p> <p><span><strong>Shortcomings in the 2008 Law on Religious Associations</strong></span></p> <p><span><strong>M<span><span>ilitarisation of the secondary education system </span></span></strong></span></p> <p><span><strong>Trial of civilians in military courts</strong></span></p> <p><span><span>1 </span>This submission was prepared in June 2014 on the basis of the latest information available.</span></p> <p><span><span>Conscientious objection to military service</span></span></p> <p><span>2 Military service is obligatory for males aged 18 to 27 under the 1992 Law On Compulsory Military Service. The normal duration was reduced in 1994 from 24 months (as inherited from the Soviet Union) to 18 months and again in 2005 to 12 months. Graduates serve for 9 months.</span></p> <p><span>3 Limited provisions for conscientious objection to military service were introduced in the 1994 Law On Alternative (Non-military) Service. A “member of a registered religious organisation whose dogma forbids the use of arms and service in the Armed Forces” “may enlist for alternative service” whose duration is twice that of military service.<a href="#sdfootnote1sym">1</a></span></p> <p>4 This <span><span><span><span>Alternative Service was not primarily intended for any form of conscientious objector. It was required of those exempted from military service on grounds of family circumstances (eg. fathers of children), or because a brother died while performing military service,</span></span></span></span><span><span><span><span><a href="#sdfootnote2sym">2</a></span></span></span></span><span><span><span><span> and also apparently of some of those excused military service on health grounds.</span></span></span></span><span><span><span><span><a href="#sdfootnote3sym">3</a></span></span></span></span><span><span><span><span> The legislation followed a pattern developed in some other former Soviet republics, notably Moldova. Instead of dedicated placements, those performing “alternative service” “work in the national economy of the Kyrgyz Republic regardless of the [organisation's] departmental affiliation, form of ownership and management structure and, as a rule, in the citizen's permanent place of residence.”</span></span></span></span><span><span><span><span><a href="#sdfootnote4sym">4</a></span></span></span></span><span><span><span><span> </span></span></span></span></p> <p><span>5 Instead of dedicated placements, those performing “alternative service” “work in the national economy of the Kyrgyz Republic regardless of the [organisation's] departmental affiliation, form of ownership and management structure and, as a rule, in the citizen's permanent place of residence.”<a href="#sdfootnote5sym">5</a> Seemingly, all that a person who is accepted for alternative service has to do is (under the supervision of the Ministry of Defence) find employment – perhaps even retain his previous employment. The only condition is that while he is performing alternative service 20% of his salary is diverted to the Ministry of Defence – thus a substantial military tax replaces uniformed service. By 1997, it appears that as many persons annually were embarking on alternative service as were serving as conscripts in the army, although it would seem that an equally large group were either completely exempted or successfully evaded conscription.<a href="#sdfootnote6sym">6</a> It is not however known how many have at any stage applied, successfully or unsuccessfully, for recognition as conscientious objectors. One isolated case was reported from In November 2001 when Dmitri Shukhov, a Baptist, was sent for a psychiatric investigation after his refusal to swear the military oath, having previously been told that he was ineligible for alternative service because of his church's failure to register.<a href="#sdfootnote7sym">7</a></span></p> <p><span>6 In its concluding observations on the initial report under the ICCPR of Kyrgyzstan [“The Kyrgyz Republic”], which it examined in July 2000,<a href="#sdfootnote8sym">8</a> the Human Rights Committee noted “that conscientious objection to military service is allowed only to members of a registered religious organisation whose teachings prohibit the use of arms.” Citing Articles 18 and 26, the Committee also regretted “that the State party has not sought to justify why the provision on alternative service entails a period of service twice as long as that required of military conscripts, and why persons of higher education serve for a considerably lesser period in the military and in alternative service.” and recommended “Conscientious objection should be provided for in law, in a manner that is consistent with articles 18 and 26 of the Covenant, bearing in mind that article 18 also protects freedom of conscience of non-believers. The State party should fix the periods of military service and alternative service on a non-discriminatory basis.” </span></p> <p><span>7 An amended version of the Law on Alternative (Non-Military) Service was promulgated in June 2002. The duration of alternative service was reduced to 24 months (or 18 months for those with higher education). There was however no change in the criteria on which “religious” applications could be accepted had been revised. The reduction in the ratio between the lengths of military and alternative service was probably accidental; a Bill to reduce military service to 12 months (and to introduce a direct buying-out option) was approved by the Parliament in the same year, but ultimately rejected by the Government.<a href="#sdfootnote9sym">9</a> </span></p> <p><span><span><span><span>8 In July 2005 an amendment to the Law On Compulsory Military Service</span></span></span></span><span><span><span><span><a href="#sdfootnote10sym">10</a></span></span></span></span><span><span><span><span> finally brought the long-anticipated reduction to 12 months in the duration of military service,</span></span></span></span><span><span><span><span><a href="#sdfootnote11sym">11</a></span></span></span></span><span><span><span><span> but there was no accompanying change in the duration of alternative service, which thus once again became twice as long. The possibility of “buying out” of all except a one-month training resurfaced in a law of 2009; a fee </span></span></span></span>of 12,000 soma (approximately $250) was set. This part of the law was reportedly repealed the next year after a change of Government,<a href="#sdfootnote12sym">12</a> and a Law of 15th June 2012 abolished the “recruiting mobilisation reserve” to which those who had taken advantage of the buying-out provision had been allocated, the authorities having come to the conclusion that a reserve force whose members had undergone only one month's military training was not useful.<a href="#sdfootnote13sym">13</a></p> <p>9 In 2012, the Supreme Court agreed to suspend proceedings against ten Jehovah's Witnesses who were refusing to perform either military service or the alternative service offered, in order to obtain a ruling on the constitutionality of <span><span><span>the</span></span></span><span><span><span> </span></span></span><span><span><span>Military</span></span></span><span><span><span> </span></span></span><span><span><span>Service</span></span></span><span><span><span> </span></span></span><span><span><span>Law.</span></span></span><span><span><span><a href="#sdfootnote14sym">14</a></span></span></span></p> <p><span><span>10 As</span><span> </span><span>reported</span><span> </span><span>by</span><span> </span><span>the</span><span> </span><span>Jehovah's</span><span> </span><span>Witnesses,</span><span> </span><span>their</span><span> </span><span>complaint</span><span> </span><span>was</span><span> </span><span>that</span><span> </span><span>the</span><span> </span><span>Law</span><span> </span><span>did</span><span> </span><span>not</span><span> </span><span>offer</span><span> </span><span>a</span><span> </span><span>truly</span><span> </span><span>civilian</span><span> </span><span>alternative</span><span> </span><span>service,</span><span> </span><span>as</span><span> </span><span>guaranteed</span><span> </span><span>by</span><span> article 56.2 of </span><span>the</span><span> </span><span>Constitution,</span><span> especially </span><span>in</span><span> </span><span>that</span><span> </span><span>under</span><span> </span><span>article</span><span> </span><span>32.4</span><span> </span><span>of</span><span> </span><span>the</span><span> </span><span>Law</span><span> “</span><span>alternative</span><span> </span><span>service</span><span> </span><span>includes</span><span> </span><span>making</span><span> </span><span>monetary</span><span> </span><span>contributions</span><span> </span><span>by</span><span> </span><span>those</span><span> </span><span>in</span><span> </span><span>alternative</span><span> </span><span>service</span><span> </span><span>to</span><span> </span><span>a</span><span> </span><span>special</span><span> </span><span>account</span><span> </span><span>of</span><span> </span><span>the</span><span> </span><span>Ministry</span><span> </span><span>of</span><span> </span><span>Defence...</span><span>”</span><span><a href="#sdfootnote15sym">15</a></span><span> </span><span>They</span><span> </span><span>also</span><span> </span><span>complained</span><span> </span><span>that</span><span> </span><span>alternative</span><span> </span><span>service</span><span> </span><span>was</span><span> </span><span>supervised</span><span> </span><span>by</span><span> </span><span>military</span><span> </span><span>personnel,</span><span> </span><span>and</span><span> </span><span>that</span><span> </span><span>those</span><span> </span><span>who</span><span> </span><span>performed</span><span> </span><span>it</span><span> </span><span>were</span><span> </span><span>automatically</span><span> </span><span>entered</span><span> </span><span>in</span><span> </span><span>the</span><span> </span><span>military</span><span> </span><span>reserves.</span><span><a href="#sdfootnote16sym">16</a></span><span> The Jehovah's Witnesses reveal that three of their members who were convicted in 2012 over their refusal to perform either military service or the existing alternative service had addressed individual communications to the Human Rights Committee in this respect.</span><span><a href="#sdfootnote17sym">17</a></span></span></p> <p><span>11 The Court had noted that the complaints regarding the alternative service arrangements were:</span></p> <p><span><span>"(a) this service requires to pay money directly to the Defence Ministry for support of the military and military activity;</span></span><br /> <span><span>(b) places the conscientious objector under the direct control and supervision of the military; and </span></span><br /> <span><span>(c) enlists the conscientious objector in the Armed Forces as an 'obligated reservist'”</span></span> </p><p>It found all three complaints justified and ordered immediate amendment of the relevant legislation.<a href="#sdfootnote18sym">18</a> The Court meanwhile rejected a challenge to the constitutionality of Article 351.2 of the Criminal Code, under which between 2007 and 2013 42 Jehovahs' Witnesses had been prosecuted for evasion of alternative service”.<a href="#sdfootnote19sym">19</a></p> <p>12 On 17th February, 2014, amendments to the Military Service Law were put before <span><span>the </span></span><span><em><span>Zhogorku Kenesh, </span></em></span><span><span><span>or Parliament. The Committee notes the State party’s initiative to amend the Law on Universal Conscription of Citizens of the Kyrgyz Republic on Military and Alternative Service.”<a href="#sdfootnote24sym">24</a></p> <p><span>“Law on Freedom of Worship and Religious Organisations”</span></p> <p>17 Although a formal registration requirement for all religious groups functioning in Kyrgyzstan was introduced by presidential decree in 1996, for many years registered and unregistered denominations of all faiths worshipped with very little interference by the authorities, in stark contrast to the situation elsewhere in Central Asia.<a href="#sdfootnote25sym">25</a> The 2008 Law, however, requires all worshipping communities or congregations to re-register, showing that they contain at least 200 adult citizens. All gatherings for worship by unregistered groups are banned, as are also any form of proselytism, the distribution of religious literature or audio-visual materials anywhere other than in a property owned by the religious organisation concerned. Implementation has been even more repressive – Ahmadis and all Christian denominations except Russian Orthodox have been denied re-registration, or had their applications blocked. Forum 18 reveals that two individual communications from different Jehovah's Witness groups on this subject have been addressed to the Human Rights Committee.<a href="#sdfootnote26sym">26</a> The Jehovah's Witness community in Kyrgyzstan grew steadily over the decade 1998 – 2008 from approximately 3,500 to approximately 4,500 adherents.<a href="#sdfootnote27sym">27</a> If recognition were denied and they were effectively outlawed it would be very hard under the existing legislation for their members to be excused military service, to which they are implacably opposed.</p> <p>18 In its Concluding Observations on Kyrgyzstan's Second Periodic Report under the ICCPR, the Human Rights Committee addressed these issues in the following words:</p> <p>“While noting the planned amendments to the 2008 Law on Freedom of Conscience and Religious Organizations in the Kyrgyz Republic, the Committee is concerned about the restrictions in the current law that are incompatible with provisions of the Covenant, including with respect to missionary activities, the registration procedure and dissemination of religious literature. The Committee is also concerned about reports of religious intolerance with respect to converts from the majority religion, including incidents of hate speech.</p> <p>“The State party should ensure that the legislative amendments to the 2008 Law on Freedom of Conscience and Religious Organizations in the Kyrgyz Republic remove all restrictions that are incompatible with article 18 of the Covenant, by providing for a transparent, open and fair registration process for religious organizations and eliminating distinctions among religions that may lead to discrimination. The State party should take measures, including through public statements and awareness-raising campaigns, to promote religious tolerance and condemn any act of religious intolerance and hatred. The State party should also investigate all cases of violence based on religion, prosecute perpetrators and compensate victims.”<a href="#sdfootnote28sym">28</a></p> <p><span>Militarisation in schools and juvenile recruitment</span></p> <p>19 According to the Initial <span><span><span> Report of Kyrgyzstan under the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict, “male citizens desiring to pursue their studies at a military academy may be admitted to such an institution at the age of 17 or if they turn 17 in the year they enter the academy.” In other words, students aged 16 may be admitted. “Citizens admitted to military academies are deemed to be national servicemen and shall be called cadets. They shall be subject to the same obligations as those prescribed for national servicemen.” </span></span></span></p> <p><span>20 It seems clear that this wording at present applies to just one institution “The Lieutenant-General Kalyinur Usenbekov Higher Military Academy”, in Bishkek, where, at the beginning of the 2005/2006 academic year, 26 of 104 cadets were aged 17<a href="#sdfootnote29sym">29</a>. “First year cadets are not allowed to take part in military operations.”<a href="#sdfootnote30sym">30</a> Written replies to supplementary questions by the Committee on the Rights of the Child revealed that entrants to the College must produce written authorisation from a parent or guardian, and that “all graduates continue their military service at officer rank (…), except for those discharged from military service for reasons of health or family circumstances.”<a href="#sdfootnote31sym">31</a> </span></p> <p><span>21 When delivering its report, Kyrgyzstan was embarrassed by the fact that another institution, the Dair Asanov Kyrgyz State Military High School had recently come under the direct administration of the Ministry of Defence. From the discussion it appears that this had happened against a background of severe bullying.<a href="#sdfootnote32sym">32</a> Statistics provided to the Committee on the Rights of the Child showed that the 212 15-year-olds at the start of the 2004/5 academic year, dwindled to a cohort of only 59 sixteen-year-olds at the start of the following year, as against something between 160 and 175 who might have been expected based on the figures from other years.<a href="#sdfootnote33sym">33</a> Mass fighting between second and third year students at this school was again reported in April 2007.<a href="#sdfootnote34sym">34</a> Whatever the problems of the Dair Asanov school, however, it is clear that pupils at this school, who generally enrol at the age of 14 or 15, are not considered to be serving members of the armed forces.</span></p> <p><span>22 It also emerged when Kyrgysztan reported under the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict that:</span></p> <p>“<span>Schoolchildren attend classes in military preparation and patriotism as part of their pre-conscription preparatory course, for which two hours per week are assigned in the curriculums of general education schools for students in grades 10 and 11 (ages 15 and 16).” This includes “training and field exercises (…) over a period of three days (18 hours) in April and May, conducted together with the Ministry of Defence (…), during which pupils in the 11th grade learn to handle weapons and are taught how to shoot. Girls undergo practical training in (…) medical and nursing duties.” Furthermore, “in higher educational establishments, male students attend classes in military faculties.”<a href="#sdfootnote35sym">35</a> </span></p> <p><span>Military courts</span></p> <p>23 The trial of civilians in military courts was addressed by the Human Rights Committee in March 2014 in the This is the first substantive resolution on the subject from the Council, and goes beyond previous resolutions from the Commission on Human Rights (which the Council replaced). It was adopted by consensus. <p><em>Reaffirming also</em> that the right to freedom of thought, conscience and religion shall include freedom to have or to adopt a religion or belief of one’s choice, and freedom, either individually or in community with others and in public or private, to manifest one’s religion or belief in worship, observance, practice and teaching, and that no one shall be subject to coercion which would impair one’s freedom to have or to adopt a religion or belief of one’s choice, as well as that freedom to manifest one’s religion or beliefs may be subject only to such limitations as are prescribed by law and are necessary to protect public safety, order, health or morals or the fundamental rights and freedoms of others,</p> <p><em>Recalling</em> article 14 of the Universal Declaration of Human Rights, which recognizes the right of everyone to seek and enjoy in other countries asylum from persecution,<br /> Recalling also all previous relevant resolutions and decisions, including Human Rights Council resolution 20/2 of 5 July 2012 and Commission on Human Rights resolutions 2004/35 of 19 April 2004 and 1998/77 of 22 April 1998, in which the Commission recognized the right of everyone to have conscientious objection to military service as a legitimate exercise of the right to freedom of thought, conscience and religion, as laid down in article 18 of the Universal Declaration of Human Rights and article 18 of the International Covenant on Civil and Political Rights and general comment No. 22 (1993) of the Human Rights Committee,</p> <p><em>Noting</em> general comment No. 32 (2007) of the Human Rights Committee, in which it stated that repeated punishment of conscientious objectors for not having obeyed a renewed order to serve in the military based on the same constant resolve may amount to punishment in breach of the legal principle <em>ne bis in idem</em>, </p> <p><em>Recognizing</em> that conscientious objection to military service derives from principles and reasons of conscience, including profound convictions, arising from religious, ethical, humanitarian or similar motives,</p> <p><em>Aware</em> that persons performing military service may develop conscientious objections,</p> <p>1. <em>Recognizes</em> that the right to conscientious objection to military service can be derived from the right to freedom of thought, conscience and religion or belief;</p> <p>2. <em>Takes note</em> of the analytical report on conscientious objection to military service presented by the United Nations High Commissioner for Human Rights to the Human Rights Council at its twenty-third session pursuant to resolution 20/2 ;1</p> <p>3. <em>Encourages</em> all States, relevant United Nations agencies, programmes and funds, intergovernmental and non-governmental organizations and national human rights institutions to cooperate fully with the Office of the High Commissioner by providing relevant information for the preparation of the next quadrennial analytical report on conscientious objection to military service, in particular on new developments, best practices and remaining challenges;</p> <p>4. <em>Takes note</em> of the publication by the Office of the High Commissioner of a guide entitled <em>Conscientious Objection to Military Service</em> (2012);</p> <p>5. <em>Acknowledges</em> that an increasing number of States recognize conscientious objection to military service not only for conscripts but also for those serving voluntarily, and encourages States to allow applications for conscientious objection prior to, during and after military service, including reserve duties;</p> <p>6. <em>Recognizes</em> that an increasing number of States that retain compulsory military service are taking steps to ensure the establishment of alternatives to military service;</p> <p>7. <em>Welcomes</em> the fact that some States accept claims of conscientious objection to military service as valid without inquiry;</p> <p>8. <em>Calls upon</em> States that do not have such a system to establish independent and impartial decision-making bodies with the task of determining whether a conscientious objection to military service is genuinely held in a specific case, taking account of the requirement not to discriminate between conscientious objectors on the basis of the nature of their particular beliefs;</p> <p>9. <em>Urges</em> States with a system of compulsory military service, where such provision has not already been made, to provide for conscientious objectors various forms of alternative service which are compatible with the reasons for conscientious objection, of a non-combatant or civilian character, in the public interest and not of a punitive nature;</p> <p>10. <em>Emphasizes</em> that States should take the necessary measures to refrain from subjecting individuals to imprisonment solely on the basis of their conscientious objection to military service and to repeated punishment for refusing to perform military service, and recalls that repeated punishment of conscientious objectors for refusing a renewed order to serve in the military may amount to punishment in breach of the legal principle ne bis in idem;</p> <p>11. <em>Calls upon</em> States to consider releasing individuals imprisoned or detained solely on the basis of their conscientious objection to military service;</p> <p>12. <em>Reiterates</em> that States, in their law and in practice, must not discriminate against conscientious objectors in relation to their terms or conditions of service, or any economic, social, cultural, civil or political rights;</p> <p>13. <em>Encourages</em> States, subject to the circumstances of the individual case meeting the other requirements of the definition of a refugee as set out in the Convention relating to the Status of Refugees of 1951 and the Protocol thereto of 1967, to consider granting asylum to those conscientious objectors to military service who have well-founded fear of persecution in their country of origin owing to their refusal to perform military service when there is no provision, or no adequate provision, for conscientious objection to military service;</p> <p>14. <em>Also encourages States</em>, as part of post-conflict peacebuilding, to consider granting and effectively implementing, amnesties and restitution of rights, in law and in practice, for those who have refused to undertake military service on grounds of conscientious objection to military service; </p> <p>15. <em>Affirms</em> the importance of the availability of information about the right to conscientious objection to military service, and the means of acquiring conscientious objector status, to all persons affected by military service;</p> <p>16. <em>Welcomes</em> initiatives to make such information widely available, and encourages States, as applicable, to provide information to conscripts and persons serving voluntarily in the military services about the right to conscientious objection to military service;</p> <p>17. <em>Urges</em> States to respect freedom of expression of those who support conscientious objectors or who support the right of conscientious objection to military service;</p> <p>18. <em>Encourages</em> States to use the information contained in the above-mentioned report and guide of the Office of the High Commission and in the present resolution to consider introducing appropriate legislation, policies and practices regarding conscientious objection to military service, and to address any discriminatory provisions therein, and to inform the enforcement of an adequate legal framework to ensure that the right can be respected in practice;</p> <p>19. <em>Invites</em> States to consider including in their national reports, to be submitted to the universal periodic review mechanism and to United Nations human rights treaty bodies, information on domestic provisions related to the right to conscientious objection;</p> <p>20. <em>Decides</em> to continue consideration of this matter under the same agenda item in accordance with its annual programme of work.</p> <p>23 September These developments will prove invaluable in future, where conscientious objectors seek redress through international mechanisms having been unjustly treated in national contexts.</p> <p>We are pleased, also, to highlight examples of best practice, where states go further than merely complying with the international standards to which they are subject.</p> <p>Many challenges remain. At worst, in countries where international standards are not met, conscientious objectors face imprisonment, sometimes repeatedly (including in Turkey and Israel). In other cases, such as Colombia, constitutionally the rights of conscientious objectors are recognised, but in practice these rights are far from upheld.</p> <h3>1. New developments</h3> <p><em>1.1 European Court of Human Rights</em></p> <p>In July 2011, ruling on the case of Bayatyan vs Armenia<a href="#fn1" id="ref1">1</a>, the Grand Chamber of the European Court of Human Rights ruled that conscientious objection to military service is protected under Article 9 of the European Convention on Human Rights and Fundamental Freedoms – the right to freedom of thought, conscience and religion. </p> <p>Bayatyan v Armenia was cited through the European Court of Human Rights in November 2011, in the case of Erçep vs Turkey<a href="#fn2" id="ref2">2</a>. The case concerned Yunus Erçep - like Vahan Bayatyan, a Jehovah's Witness - who has been repeatedly imprisoned for his refusal to perform military service. In Turkey, Yunus Erçep was subject to around 15 call-ups. The Court observed that it “had recently reviewed its case-law concerning conscientious objectors, in its Grand Chamber judgement in Bayatyan vs Armenia. In that judgement it had noted that Article 9 did not explicitly refer to a right to conscientious objection. However, it considered that opposition to military service, where it was motivated by a serious and insurmountable conflict between the obligation to serve in the army and a person’s conscience, constituted a conviction or belief of sufficient importance to attract the guarantees of Article 9. In the today's [sic] case the Court observed that Mr Erçep was a member of the Jehovah’s Witnesses, a religious group that had consistently opposed military service. There was no reason to doubt that his objection was motivated by anything other than genuinely-held religious beliefs.”</p> <p>In 2012, the European Court of Human Rights followed up the Erçep vs Turkey judgement with three more judgements against Turkey which all cited a violation of Article 9: Demirtaş vs Turkey<a href="#fn3" id="ref3">3</a>, Savda vs Turkey<a href="#fn4" id="ref4">4</a> and Tarhan vs Turkey<a href="#fn5" id="ref5">5</a>.</p> <p><em>1.2 United Nations Human Rights Committee</em><br /> The Human Rights Committee has repeatedly upheld the right to conscientious objection to military service. </p> <p>In the case of more than 100 individual complaints of conscientious objectors from the Republic of Korea, who had all been sentenced to 18 months' imprisonment. In the cases, Min-Kyu Jeong et al v Republic of Korea<a href="#fn6" id="ref6">6</a>, the Committee held that conscientious objection to military service “inheres in the right to freedom of thought, conscience and religion. It entitles any individual to an exemption from compulsory military service if this cannot be reconciled with that individual's religion or beliefs. The right must not be impaired by coercion.”</p> <p>In the cases of Turkish Jehovah's Witnesses Atasoy and Arda Sarkut<a href="#fn7" id="ref7">7</a>, the Committee published its views in March 2012, stating that “Although the Covenant does not explicitly refer to a right of conscientious objection, the Committee reaffirms its view that such a right derives from article 18, inasmuch as the obligation to be involved in the use of lethal force may seriously conflict with the freedom of conscience. The Committee reiterates that the right to conscientious objection to military service is inherent to the right to freedom of thought, conscience and religion. It entitles any individual to an exemption from compulsory military service if the latter cannot be reconciled with the individual's religion or beliefs. The right must not be impaired by coercion."</p> <h3>2. Best practice</h3> <p><em>2.1 Non-punitive nature of substitute service</em><br /> Substitute service required of conscientious objectors in lieu of compulsory military service must be compatible with the reasons for the objection, of a civilian character, in the public interest and not of a punitive nature<a href="#fn8" id="ref8">8</a>. The term “punitive” covers the duration of substitute service and the type of service required of conscientious objectors, as well as the conditions under which it is served.</p> <p>In Denmark, substitute service is non-punitive in terms of length. At four months long, substitute service is the same length as military service. Conscription is only enacted in Denmark when there is a shortage of recruits.</p> <p><em>2.2 No substitute service</em><br /> Since 2011, Norway has suspended substitute service for conscientious objectors. Conscientious objectors to military service are no longer called up for a substitute service, but are simply exempted from military service.</p> <p><em>2.3 Claims to conscientious objection accepted as valid 'without inquiry'</em><br /> The UN Commission on Human Rights has welcomed the fact that some States accept claims of conscientious objection as valid without inquiry<a href="#fn9" id="ref9">9</a>.</p> <h3>3. Remaining challenges</h3> <p><em>3.1 Gap between policy and provision</em><br /> There remains in some States a mismatch between constitutional recognition, and the accompanying recognition of conscientious objectors in practice.</p> <p>Art. 216 of the Colombia constitution provides for compulsory military service for men aged 16 – 28. The constitution also states that "freedom of conscience is guaranteed. No one will be obliged to act against their conscience." In October 2009, the Constitutional Court of Colombia ruled that there is a right to conscientious objection to military service under the Colombian constitution, and urged the Colombian Congress to pass a law to regulate the right to conscientious objection.<br /> This law has not yet been passed, and therefore, there is currently no legislative procedure to achieve CO status – in practice the right does not exist at the moment.</p> <p><em>3.2 Lack of implementation</em><br /> New developments in terms of conscientious objection to military service include the judgement in the cases of Bayatyan vs Armenia. This judgement, issued on 7 July 2011, is yet to be implemented. The state of Armenia continues to imprison conscientious objectors, under Article 327, Part 1, of the criminal code, which punishes evasion of the call-up to military or alternative service. Recently, these have included Anania Grigoryan and Artsrun Khachatryan, sentenced in June and July 2012 respectively, and imprisoned after their appeals were rejected on 15th and 26th November. They are incarcerated in Nubarashen prison, with sentences of 24 and 30 months respectively.</p> <p>There has been a similar failure to European Court of Human Rights rulings in the case of Turkey – conscientious objector İnan Suver being detained again on 12 September 2012.</p> <p><em>3.3 Discrimination based on differing motivations</em><br /> No discrimination is permitted amongst conscientious objectors. General Comment 22, paragraph 11 affirms that "there shall be no differentiation among conscientious objectors on the basis of the nature of their particular beliefs". This is not always translated into practice. </p> <p>In Finland, Jehovah's Witnesses, whose conscientious objection is derived from their religious belief, are exempted from military service in peace time. This amounts to preferential treatment of Jehovah's Witnesses compared to other conscientious objectors.</p> <p>The Human Rights Committee's 2004 Concluding Observations on Finland called upon the State to end this discrimination<a href="#fn10" id="ref10">10</a>, but this remains unheeded. </p> <p><em>3.4 Repeated punishment</em><br /> Conscientious objectors who remain unrecognised by their States can face repeated punishment for their ongoing refusal to partake in military service. This is in violation of article Article 14, paragraph 7 of the ICCPR, which states that no one no one shall be liable to be tried or punished again for an offence of which they have already been finally convicted or acquitted in accordance with the law and penal procedure of each country. The UN Working Group on Arbitrary Detention has also addressed the prohibition of repeated punishment of conscientious objectors because of their continued refusal to undertake military service, finding repeated imprisonment to be arbitrary detention.<a href="#fn11" id="ref11">11</a></p> <p>Yet conscientious objectors do regularly face repeated imprisonment. Having declared his refusal to serve in the Israeli military at an Induction Base, conscientious objector Natan Blanc has imprisoned for ten days for the first time on 20 November 2012. On his release, he was again called up, and again refused to serve, whereupon he was imprisoned for twenty days. This process of call up, refusal, imprisonment and release has been repeated four times thus far. As I write, Natan Blanc is imprisoned for the sixth time, until 27 February 2013.</p> <p><em>3.5 Freedom of expression</em><br /> Freedom to advocate conscientious objection to military service, and make accompanying criticisms of military institutions, are not always respected. Article 318 of the Turkish penal code prohibits 'alienating the people from military service'. In February 2012,Turkish conscientious objector Halil Savda was arrested and sentenced to 100 days imprisonment for a violation of Article 318. The charges against Halil, in this instance, related to his 2006 statements of solidarity with Israeli conscientious objectors. </p> <p>Article 318 represents an unfair limitation of the right to freedom of expression in Turkey, potentially criminalising any criticism of the Turkish military. The Human Rights' Committee's General Comment 34 on Article 19 makes explicit that State parties should not prohibit criticism of institutions, such as the army or the administration. <a href="#fn12" id="ref12">12</a></p> <p>The Human Rights Committee's Concluding observations (2012) notes that human rights defenders and journalists continue to be subjected to convictions including criticism of the military (under article 318 of the Turkish penal code), and calls upon the Turkish government to ensure that relevant provisions of the penal code - are brought into line with article 19 of the CCPR<a href="#fn13" id="ref13">13</a>.</p> <p><em>3.6 Conscientious objection of professional soldiers</em><br /> Challenges remain around the right to conscientious objection to military service for members of the armed forces who have joined voluntarily, but who develop a conscientious objection.</p> <p>For those in the United States military, gaining recgonition of conscientious objector status can take over two years. In this time, deployment is likely. Many unrecognised conscientious objectors go absent without leave. </p> <p>Likewise, in the UK, when former Leading Medical Assistant Michael Lyons refused to undertake weapons training whilst his application for release on grounds of conscientious objection was pending, he was found guilty of wilfully disobeying this order, and was detained for eight months in the “Armed Forces Correctional Establishment” at Colchester.</p> <p><em>3.7 Lack of information</em><br /> Of the status of conscientious objection in some states we remain woefully ignorant. Our information regarding military service in Eritrea is obtained through accounts of those who have have fled from Eritrea. Many of the Eritrean Diaspora remain scarred to speak out because of perceptions of the strength of the Eritrean regime to reach them in exile, and their families in Eritrea. We have details of many conscientious objectors who have been imprisoned. We are unable to discover whether they remain incarcerated. Three – Paulos Eyassu, Negede Teklemariam, Isaac Mogos – were detained 19 years ago, on 24 September 1994, and as far as we know, are still imprisoned at Sawa Military Camp.</p> <p>-------------------------------------------------------</p> <h3>Notes</h3> <p>1.
